Extensions and change of purpose
§ 35–37, 42–45 of Act No. 326/1999 Coll.
A Czech status lives in cycles: every permit must be extended on time, and a new job, business or course of study means changing the purpose correctly. A missed deadline costs the most here.
What the law says
An extension is filed before the current permit expires; the law opens the filing window in advance (120 days for most cards). A timely application triggers the fiction of stay: while the authority decides, the previous status is deemed to continue and you live and work lawfully.
A change of purpose is separate proceedings: moving from study to employment, employment to business and back is possible in-country if the new purpose’s conditions are met. Some transitions require a minimum prior stay — checked before filing, not after a refusal.
How the work runs
I keep the calendar of your deadlines: when the window opens, which documents to refresh (income, housing, insurance), what has changed in OAMP practice since last time. I file under a power of attorney and close the authority’s requests without you where permitted.
For a change of purpose I model the transition first: will the new purpose hold, will a gap open? If the move is risky, I propose a sequence — extend on the current purpose first, then switch with a calm margin of time.
Deadlines and pitfalls
The classic mistake is filing on the last day with an incomplete file: a formal defect becomes a missed deadline, no fiction arises, the status resets. The second is changing employers without notice or too early — Employee Cards have their own rules, and the breach surfaces at the next extension.
Frequently asked questions
I filed for an extension but my card has expired. Am I legal?
If the application was filed on time and accepted, the fiction of stay runs: you are legal until the decision. The bridging sticker or the authority’s confirmation is your proof — worth obtaining, especially for travel and your employer.
Can I travel while the extension is pending?
Short trips are possible under the fiction of stay, but re-entering Schengen depends on the documents in hand; sometimes a bridging visa is needed. Check your exact combination of statuses before buying tickets.
How early can I file for an extension?
The window opens in advance — 120 days before expiry for most cards; the last day of validity is the final deadline. Earlier filings are not accepted, later ones sink the status; I keep the calendar for you.
What is the bridging sticker (překlenovací štítek)?
Proof of the fiction of stay — a sticker or certificate the OAMP issues on request once the extension is filed on time. Useful for travel, the employer and the bank; I obtain it right after filing.
I changed my address or passport. Must I report it?
Yes — changes of address, document and, for Employee Cards, employer are notified within statutory deadlines. Failing to notify is a misdemeanour and a minus at the next extension.
